Terms
These terms apply when you use loravello.com, request a free concept or buy services from us. Loravello is a brand of Sapphire Capital LLC, a Wyoming limited liability company. "We" and "us" mean Sapphire Capital LLC, doing business as Loravello; "you" means the person or business using the site or buying from us.
This website
The films, frames, designs and text on this site are Loravello's work unless stated otherwise. Studio Concepts and Lab pieces are made by Loravello and feature fictional brands and places; they are not client work.
Free concepts
A free concept is a first creative direction for your business, such as a style frame, a treatment, a storyboard or a website concept. It is offered without payment and without obligation on either side: you don't have to go ahead, and neither do we. It is not a finished film or website, and it does not include paid production.
A free concept stays ours and is shared with you so you can evaluate it. If you decide not to go ahead, please don't use or reproduce the concept itself commercially, or have it produced elsewhere, without our permission or a separate agreement. Your own ideas and material remain yours to use as you like.
Quotes and approval
Before paid work begins, we confirm the scope and price with you in writing, usually in a quote or proposal sent by email. You accept it by confirming in writing (an email reply is enough) or by paying, whichever happens first.
A quote or proposal can include terms specific to your project. Where it expressly differs from these terms, it applies to that project, subject to applicable law. Changes to the scope, and any additional charges, need your written approval before the additional work begins.
Payment
Fixed-price packages are paid in full upfront. Production begins once the scope is agreed and your payment has cleared.
For Immersive and Custom projects, your quote or proposal sets out how payment works: either full payment upfront, or a deposit and milestone payments. Where your project's payment terms are stated, they apply.
Cancellations and refunds
If you cancel a fixed-price package before production begins, we'll refund your payment in full, less any third-party costs we agreed with you in advance would be non-refundable.
Once production has begun, payments are generally non-refundable to the extent work has started or costs have been incurred, unless your project agreement says otherwise. For Immersive and Custom projects, your quote or proposal may set out its own cancellation and refund terms.
Approved third-party costs already incurred for your project may not be refundable where the law allows. These can include specifically licensed stock or media, paid project-specific assets, project-specific software or licences, domain or hosting costs and other approved production expenses.
Nothing in this section limits any refund rights you have under applicable law.
Revisions
Each package includes a set number of revision rounds. Cinematic content: Essential 1, Signature 2, Campaign 3. Interactive websites: Launch 1, Signature 2, Immersive 3. Custom projects and retainers include the revisions set out in their quote or proposal.
A revision round is one consolidated set of feedback, sent together. Choosing or approving the initial creative direction doesn't use a round.
A revision adjusts the approved direction. Changes beyond it are scope changes and are quoted separately: for example additional pages, scenes or deliverables, formats not included in the scope, new functionality, substantial new animation or 3D work, or moving to a substantially different concept after the direction is approved. Revision rounds beyond your package's allowance are also quoted separately, and we'll ask for your approval before doing that work.
Timelines and delivery
Timelines are estimates unless we expressly agree a specific deadline in writing. If assets, information, approvals or feedback arrive later than planned, the schedule may move accordingly.
Cinematic work is generally complete when we deliver the final files. Website work is generally complete when the site is deployed and handed over as agreed in the scope.
Please keep your own copies of your final deliverables. We don't promise to store project files indefinitely.
If a project goes quiet
If we need something from you and haven't heard back for around 14 days, we may send a reminder, and the schedule may move. After around 30 days, we may pause the project, and the original production slot may no longer be available. If there's still no response 60 or more days after our written reminders, we may treat the project as inactive and close it.
You can pick it up again later. That may mean rescheduling and, where additional work is needed, a new quote. Closing an inactive project doesn't by itself mean you lose any payment: payments and refunds still follow your project's terms and applicable law.
What you send us
Your material stays yours. By sending material, whether for a concept or for paid work, you confirm you have the rights and permissions needed to share it with us and for us to use it in your project. That includes, where they apply, photos, video, logos, trademarks, copy, music, the likeness of anyone shown, brand assets and any third-party material you link to.
You're responsible for the accuracy of the facts you give us, such as prices, specifications, property details, business information and product claims.
We may decline material where the rights are unclear, or where the requested use appears unlawful, infringing, deceptive or harmful.
Generative and AI tools
We use generative and AI tools where they genuinely help a project, alongside editing, design, code and 3D. We tell you when we use them on your project, and where they materially shape your deliverables, your quote or proposal says so.
Generated media can vary and may contain artefacts. We review generated material as part of production, and you can give feedback through your project's review and revision process. We can't guarantee pixel-perfect realism from generative material.
Unless exclusivity is specifically agreed in writing, generated elements aren't guaranteed to be unique or exclusive to you. When we use third-party generative services, they may process the project material we give them.
Ownership
Your material stays yours. After full payment, you own the final custom deliverables we create specifically for you, subject to the points below and to anything your project agreement says.
Sapphire Capital LLC keeps ownership of its pre-existing and reusable material: tools, reusable code, methods, workflows, templates, systems, production techniques and know-how. Where any of it forms part of your deliverables, you receive the rights you need to keep using the completed film or website, without an ongoing Loravello subscription.
Third-party components, such as fonts, software libraries, music, stock media and other licensed material, remain subject to their own licences.
Concepts, working versions and directions that aren't part of your final deliverables remain ours unless we agree otherwise.
Showing your work
We won't publicly publish your material, your project work or your finished deliverables without your permission. If we'd like to show a project in our portfolio, we'll ask you for that specific project.
Websites and handoff
There's no lock-in. Your domain should be registered to you and under your control. Where practical, the production hosting and other important third-party accounts are set up in your name or transferred to you.
After full payment, you receive the completed website, the source code and project files reasonably necessary to operate it, and handoff information. Paid third-party licences remain subject to their licence terms.
Website Care isn't required for your site to keep working, and cancelling Care doesn't disable it. After handoff, you're responsible for your own hosting, domain, third-party services and paid licences, unless we agree otherwise.
Website Care
Care is optional. Care for Launch websites is $49 a month and includes up to 30 minutes of minor updates. Signature Care is $99 a month with up to 1 hour. Immersive Care is $149 a month with up to 2 hours.
Care is billed monthly in advance, with no minimum commitment. You can cancel anytime; cancellation takes effect at the end of the current paid billing period. Partial months aren't refunded, except where the law requires. Unused update time doesn't roll over.
Minor updates include things like text changes, image swaps, small content adjustments and minor fixes. Routine Care doesn't include new pages, redesigns, new functionality, substantial development, major content additions, new animation work or new 3D work; we quote those separately. Work beyond your included allowance is also quoted separately and needs your approval first.
When Care ends, the monitoring and hosting oversight it provides end with the paid period. Your ownership and use of your website don't.
Content retainers
Monthly content retainers are governed by their individual proposal, which sets the deliverables, price, billing schedule and cancellation terms.
What we don't promise
We make every film and website to work hard for your business, but we don't guarantee business outcomes such as leads, sales, conversions, search rankings, social views or engagement.
Websites are built and tested for current mainstream browsers and devices at handoff. Subject to applicable law, we're not responsible for outages or changes caused by third-party services outside our control, such as hosting, form, payment or platform providers. Neither of us is responsible for delays or failures caused by events beyond our reasonable control.
Governing law and your rights
These terms are governed by the laws of the State of Wyoming. If you buy from us as a consumer, nothing in these terms limits any rights or protections you have under the law that applies to you which can't be waived or limited by contract.
